Yes, SafeOpt is compliant with U.S. regulations, including the California Consumer Privacy Act (CCPA). However, we do not support HIPAA and exclude European and Canadian IPs from the network by default to comply with GDPR (EU) and PIPEDA (Canada).

Does Safeopt Comply With The Can-Spam Act?

Yes. The CAN-SPAM Act does not require prior consent (opt-in) to send commercial emails. However, SafeOpt ensures compliance by following FTC regulations, which include:

  1. Providing opt-in and opt-out options in every email.

  2. Following the "Initiator" guidelines for commercial email.

  3. Requiring clients to:

    1. Include a physical mailing address in emails.

    2. Clearly state that the email is an advertisement (unless the recipient has subscribed to your email list).

    3. Include an unsubscribe mechanism.

Once a recipient subscribes to your email list directly, you are no longer required to mark emails as advertisements.

What Does My Privacy Policy Need To Include?

Your website’s privacy policy, privacy notice, and Terms of Use/Terms and Conditions (or other consumer-facing disclosures) must:

  • Address any required disclosures regarding the use of third-party tools that automatically collect information about website visitors or use personal data for targeted advertising.

  • Comply with all applicable privacy laws.

  • Ensure that you obtain any legally required consents or authorizations from your customers.
